Issue

Whether the Court of Appeal erred in finding that the Appellant did not have standing to pursue an appeal.

Facts

On 19 November 2019, Liquidators were appointed to Dondore Incorporated, following the failure to pay service charges on the property to which the Appellant is in occupation. Following the making of various costs orders against the Appellant, on 22 June 2023, the British Virgin Islands (“BVI”) Commercial Court granted the First Respondent an order for sale in respect of the Appellant’s shareholding in Dondore. On 31 July 2024, The BVI Court of Appeal found that the Appellant did not have standing to pursue an appeal. This resulted in a strike out order on 31 October 2024. On 25 March 2025, the BVI Court of Appeal refused permission to appeal the strike out order. The Appellant now appeals to the Privy Council.
