(1) What test should the court apply when considering an application to extend time to bring an appeal against a criminal conviction and sentence? (2) Should the Court of Appeal have granted the appellant’s application for an extension of time for bringing his appeal?
Facts
The appellant was convicted of murder on 26 February 2013 and then sentenced to 36 years’ imprisonment on 3 May 2013. Around six years later, on 30 May 2019, the appellant filed an appeal against his conviction and sentence. He also made an application to extend the time limit for bringing the appeal, since section 17 of the Court of Appeal Act requires appeals to be filed within 21 days of the date of conviction. The Court of Appeal refused the appellant’s application for an extension of time to appeal his conviction. The appellant now appeals to the Judicial Committee of the Privy Council.
