Facts

A&A, a construction company working in the energy sector, provided steelworks to PCTT, the state-owned petroleum company. The parties could not agree the value of those works. A&A filed a claim in the High Court. On 28 April 2014, the High Court granted judgment in favour of A&A in the sum of $9,972,262.74 plus costs. The Respondent appealed the decision on grounds including (a) that the trial judge had wrongly relied on a letter sent "without prejudice" and (b) erred in his approach to the evidence in other respects. On 12 December 2019 the Court of Appeal allowed the appeal and remitted the matter to the High Court for re-hearing. A&A now appeals to the JCPC seeking to overturn the Court of Appeal’s judgment and reinstate the decision of the High Court, along with other orders.
